What is DORA?

The Digital Operational Resilience Act (DORA) is a response to the European Commission’s Digital Finance Strategy (September 2020). It addresses risks posed by the digital transformation of financial services through a consistent regulatory framework for digital operational resilience.

More than 22,000 financial institutions and ICT service providers based in the EU will be subject to DORA. Most financial market participants – including banks, investment companies, insurance companies and intermediaries, data reporting providers, and cloud service providers – will be subject to the DORA regulatory framework.

After the 17 January 2025 deadline, enforcement will fall to designated regulators in each EU member state, known as the “competent authorities”. These authorities can enforce:

  • Administrative fines for non-compliance.
  • Withdrawal of authorisation from financial institutions that consistently fail to comply with DORA.
  • Public reprimands of institutions that fail to comply with DORA’s requirements.
  • Orders for compensatory damages to the clients, customers or third parties of a financial institution that suffer a loss due to its DORA non-compliance.
  • Remedial measures to address any weaknesses or failures in a financial institution’s operational resilience.
