We hosted the first in our series of webinars on Thursday 3 April. We covered the topic of why firms need to be concerned with AIFMD right now, looking at the level of liability from a depositary and a legal perspective. The topic was discussed in two languages, German and English, across two webinars.

Here, we are proud to present the English webinar which was hosted by Dominic Hobson of COO Connect, with a presentation by Roger Fishwick of Thomas Murray and panellists Shane Ralph of State Street and Richard Frase of Dechert.

The Alternative Investment Fund Managers Directive, or AIFMD, is having far reaching consequences in the worlds of funds, fund managers and depositary banks. Funds and fund managers falling within its purview need to appoint a depositary bank as an AIF, and depositary banks have to assume strict liability for any losses incurred by the fund of assets in custody. Fund managers must also be sure that their appointed depositary bank meets all their requirements.

This is not a liability that banks generally are happy to assume. It requires increased due diligence on their part, increased knowledge of all the various counterparties as well as increased reporting.
